En este artículo ofrecemos una visión sobre los nuevos escenarios que enfrenta la ciencia abierta en un contexto marcado por desafíos micro y macro estructurales que la pandemia de COVID-19 ha puesto de manifiesto. En primer lugar, se describen las políticas en el ámbito del acceso abierto, punta de lanza de la ciencia abierta y las resistencias que todavía encuentran estas prácticas. Se analiza, también, la participación de diferentes actores en los procesos de construcción de conocimiento científico, a través de (...) prácticas de investigación participativa y ciencia ciudadana, así como en la creciente preeminencia de los datos. Se discuten, además, las principales tensiones estructurales que aparecen en los procesos de apertura analizando la construcción de políticas públicas sobre ciencia abierta. A modo de cierre, se introduce una reflexión sobre la situación actual en la que la epidemia del coronavirus está mostrando el rol cada vez más central que las prácticas abiertas tienen y tendrán en nuestra sociedad. In 1979, A. D. Woozley proposed an interpretation of Apology 29c–d which was intended to alleviate the well-known tension between the Apology and Crito on the citizen's obligation to obey the law. According to his interpretation, the court's hypothetical offer – to release Socrates on the condition that he will be put to death if he does not give up philosophy – is not an order, but a warning as to what would happen should he accept their acquittal and yet (...) continue to philosophize. Obviously, if this is the spirit of the words he puts into the court's mouth, Socrates would not be guilty of disobedience should he refuse the offer, or even if he should accept it and then disregard the warning. Technology has substantially transformed the way legal services operate in many different countries. With a large and complex collection of digitized legal documents, the judiciary system worldwide presents a promising scenario for the development of intelligent tools. In this work, we tackle the challenging task of organizing and summarizing the constantly growing collection of legal documents, uncovering hidden topics, or themes that later can support tasks such as legal case retrieval and legal judgment prediction. Our approach to this problem relies (...) on topic discovery techniques combined with a variety of preprocessing techniques and learning-based vector representations of words, such as Doc2Vec and BERT-like models. The proposed method was validated using four different datasets composed of short and long legal documents in Brazilian Portuguese, from legal decisions to chapters in legal books. Analysis conducted by a team of legal specialists revealed the effectiveness of the proposed approach to uncover unique and relevant topics from large collections of legal documents, serving many purposes, such as giving support to legal case retrieval tools and also providing the team of legal specialists with a tool that can accelerate their work of labeling/tagging legal documents. The objective of this paper is to make visible and reflect upon the lives and experience of children from the perspective of alterity, Contesting a traditional gaze that understands childhood from the perspective of lack and negativity. The researchers–a doctoral researcher and an early childhood educator– conducted the study with two groups of children aged between four and six years old, in early childhood educational spaces in two distinct and socially unequal contexts: a group of children living in a favela (...) and a middle/upper class group. Data was produced from observing the interactions of children in play situations, and from individual and collective interviews, photographs and photo exchanges. The researchers sought, through the theoretical lenses of philosophy, sociology, and geography of childhood, to reflect on how children signify their experiences and how they announce new possibilities of relating to school culture. Play is identified as an experience that unites them as a social group, regardless of the unequal conditions in which they live, and through which it is possible to create escape routes, transcend institutional limits, exercise otherness, and produce joyful interaction. Through the ways in which they exercise their relationships with with the world through play, spaces become places and territories of childhood, expressing assigned meanings that interrogate those conventionally instituted by adults; and time is lived by children from the perspective of experience and reiteration, which confronts the chronological, linear time of rigid and standardized routines. Finally, looking at childhood from the perspective of alterity provokes us to think and produce other modes of relationship between adults and children, beyond a colonizing and tutelary perspective, as an opening and reinvention. Centra-se na Primeira República, revisando a literatura e caracterizando as práticas pedagógicas e a influência das correntes anarquistas.

The notion of “responsibility gap” with artificial intelligence (AI) was originally introduced in the philosophical debate to indicate the concern that “learning automata” may make more difficult or impossible to attribute moral culpability to persons for untoward events. Building on literature in moral and legal philosophy, and ethics of technology, the paper proposes a broader and more comprehensive analysis of the responsibility gap. The responsibility gap, it is argued, is not one problem but a set of at least four interconnected (...) problems – gaps in culpability, moral and public accountability, active responsibility—caused by different sources, some technical, other organisational, legal, ethical, and societal. Responsibility gaps may also happen with non-learning systems. The paper clarifies which aspect of AI may cause which gap in which form of responsibility, and why each of these gaps matter. It proposes a critical review of partial and non-satisfactory attempts to address the responsibility gap: those which present it as a new and intractable problem (“fatalism”), those which dismiss it as a false problem (“deflationism”), and those which reduce it to only one of its dimensions or sources and/or present it as a problem that can be solved by simply introducing new technical and/or legal tools (“solutionism”). The paper also outlines a more comprehensive approach to address the responsibility gaps with AI in their entirety, based on the idea of designing socio-technical systems for “meaningful human control", that is systems aligned with the relevant human reasons and capacities. Dans l’expérience esthétique, faut-il retrouver autant le profil émotionnel que le profil cognitif? That which no discourse of aesthetics may conceal is its necessary implication of the problematic horizon of perception, following the actual etymology of the term, derived from the Greek aisthēsis.This term contains just as much the subjective and unstable field of sensation as it does the stable field of perceptual discriminations that tend to be structured. The theoretical affirmation is that the experience of the encounter with a work of art unveils a world. No sooner do we stop seeing the work of art as an object and start seeing as a world, then we realize that art reveals itself to be the expedient that clarifies the meaning of our perceptual relationship with the world, this perceptual syntony between the essence of the world and the sensing of subjects, this expressive processuality in which activity and passivity are horizons that can certainly be distinguished in description, but that cooperate internally. How should autonomous vehicles be programmed to behave in the event of an unavoidable accident in which the only choice open is one between causing different damages or losses to different objects or persons? This paper addresses this ethical question starting from the normative principles elaborated in the law to regulate difficult choices in other emergency scenarios. In particular, the paper offers a rational reconstruction of some major principles and norms embedded in the Anglo-American jurisprudence and case law on the (...) “doctrine of necessity”; and assesses which, if any, of these principles and norms can be utilized to find reasonable guidelines for solving the ethical issue of the regulation of the programming of autonomous vehicles in emergency situations. The paper covers the following topics: the distinction between “justification” and “excuse”, the legal prohibition of intentional killing outside self-defence, the incommensurability of goods, and the legal constrains to the use of lethal force set by normative positions: obligations, responsibility, rights, and authority. For each of these principles and constrains the possible application to the programming of autonomous vehicles is discussed. Based on the analysis, some practical suggestions are offered. (shrink)

The paper has two goals. The first is presenting the main results of the recent report Ethics of Connected and Automated Vehicles: recommendations on road safety, privacy, fairness, explainability and responsibility written by the Horizon 2020 European Commission Expert Group to advise on specific ethical issues raised by driverless mobility, of which the author of this paper has been member and rapporteur. The second is presenting some broader ethical and philosophical implications of these recommendations, and using these to contribute to (...) the establishment of Ethics of Transportation as an independent branch of applied ethics. The recent debate on the ethics of Connected and Automated Vehicles presents a paradox and an opportunity. The paradox is the presence of a flourishing debate on the ethics of one very specific transportation technology without ethics of transportation being in itself a well-established academic discipline. The opportunity is that now that a spotlight has been switched on the ethical dimensions of CAVs it may be easier to establish a broader debate on ethics of transportation. While the 20 recommendations of the EU report are grouped in three macro-areas: road safety, data ethics, and responsibility, in this paper they will be grouped according to eight philosophical themes: Responsible Innovation, road justice, road safety, freedom, human control, privacy, data fairness, responsibility. These are proposed as the first topics for a new ethics of transportation. (shrink)

Schwartz developed his Theory of Basic Human Values and corresponding instruments, the portrait values questionnaire (PVQ) and the Schwartz values survey (SVS), in order to measure personal values. He uses these instruments (in a slightly modified form) in conjunction with his Theory of Cultural Value Orientations to measure cultural or societal values. His theoretical work is also used in studying organizational values; however, none of these instruments seem suitable to compare personal and perceived organizational values. If the PVQ is widely (...) used to measure personal values, and we need commensurate measures of the person and organization for comparative analysis, then can we not minimally adjust the PVQ to measure organizational values? In this article we discuss the testing of one such adjusted PVQ used for gauging universities’ organizational values. We developed the PVQ-uni to measure university values as perceived by students. We collected data from sociology departments at two universities, one in Austria ( n = 133) and one Nigeria ( n = 156). We then tested the reliability and the validity of the new instrument. Based on the data collected, we found that the PVQ-uni is a reliable and valid instrument; however, further refinements are needed for the instrument to be used successfully in Africa. (shrink)

When should we use care robots? In this paper we endorse the shift from a simple normative approach to care robots ethics to a complex one: we think that one main task of a care robot ethics is that of analysing the different ways in which different care robots may affect the different values at stake in different care practices. We start filling a gap in the literature by showing how the philosophical analysis of the nature of healthcare activities can (...) contribute to robot ethics. We rely on the nature-of-activities approach recently proposed in the debate on human enhancement, and we apply it to the ethics of care robots. The nature-of-activities approach will help us to understand why certain practice-oriented activities in healthcare should arguably be left to humans, but certain goal-directed activities in healthcare can be fulfilled with the assistance of a robot. In relation to the latter, we aim to show that even though all healthcare activities can be considered as practice-oriented, when we understand the activity in terms of different legitimate ‘fine-grained’ descriptions, the same activities or at least certain components of them can be seen as clearly goal-directed. Insofar as it allows us to ethically assess specific functionalities of specific robots to be deployed in well-defined circumstances, we hold the nature-of-activities approach to be particularly helpful also from a design perspective, i.e. to realize the Value Sensitive Design approach. Objetiva discutir teoricamente questões éticas em tratamento temático da informação e o impacto dessas sobre a acessibilidade informacional. Metodologicamente, tem-se pesquisa de ordem teórica, exploratório-descritiva e de abordagem qualitativa. Emprega revisão de literatura sobre artigos de periódicos, trabalhos publicados em eventos e capítulos de livro do campo biblioteconômico-informacional. A reflexão teórica evidencia pontos de necessário aperfeiçoamento, a fim de que se garanta um processo representativo (...) imbuído de imparcialidade, limitado à atribuição de assunto que seja concernente ao documento, mas que ao mesmo tempo, não traga perdas para o usuário da informação. Delimita-se, por fim, a necessária integração entre o trato temático, a ética e a acessibilidade informacional, em vias de fomentar a cadeia documental em torno da produção, da organização e do uso da informação. Governments are increasingly inviting patient organizations to participate in healthcare policymaking. By inviting POs that claim to represent patients, representation comes into being. However, little is known about the circumstances under which governments accept POs as patient representatives. Based on the analysis of relevant legislation, this article investigates the criteria that self-help organizations, a special type of PO, must fulfil in order to be accepted as patient representatives by governments in Austria and Germany. Thereby, it aims to contribute to the (...) discussion on the role of governments in steering SHOs. There are different degrees of regulation. Governments in both countries not only formulate explicit criteria for SHOs with respect to patient representation but also guide SHOs representing patients through implicit criteria for associations. We discuss the findings against concepts of responsiveness, authorization, and accountability. Our findings indicate that governmental steering is not negative per se as indicated by previous research but—depending on legislative criteria—can promote transparency and democratic quality in patient representation. In this paper, in line with the general framework of value-sensitive design, we aim to operationalize the general concept of “Meaningful Human Control” in order to pave the way for its translation into more specific design requirements. In particular, we focus on the operationalization of the first of the two conditions investigated: the so-called ‘tracking’ condition. Our investigation is led in relation to one specific subcase of automated system: dual-mode driving systems. First, we connect and compare meaningful human control with (...) a concept of control very popular in engineering and traffic psychology, and we explain to what extent tracking resembles and differs from it. This will help clarifying the extent to which the idea of meaningful human control is connected to, but also goes beyond, current notions of control in engineering and psychology. Second, we take the systematic analysis of practical reasoning as traditionally presented in the philosophy of human action and we adapt it to offer a general framework where different types of reasons and agents are identified according to their relation to an automated system’s behaviour. This framework is meant to help explaining what reasons and what agents play a role in controlling a given system, thereby enabling policy makers to produce usable guidelines and engineers to design systems that properly respond to selected human reasons. In the final part, we discuss a practical example of how our framework could be employed in designing automated driving systems. (shrink)

Several threads of research towards developing artificial gametes are ongoing in a number of research labs worldwide. The development of a technology that could generate gametes in vitro has significant potential for human reproduction, and raises a lot of interest, as evidenced by the frequent and extensive media coverage of research in this area. We have asked researchers involved in work with artificial gametes, ethicists, and representatives of potential user groups, how they envisioned the use of artificial gametes in human (...) reproduction. In the course of three focus groups, the participants commented on the various aspects involved. The two recurring themes were the strength of the claim of becoming a parent genetically, and the importance of responsible communication of science. The participants concurred that (a) the desire or need to have genetic offspring of one’s own does not warrant the investment of research resources into these technologies, and that (b) given the minefield in terms of moral controversy and sensitivity that characterises the issues involved, how information is communicated and handled is of great importance.
